BOLT FITNESS CLIENT POLICIES

Membership Access. This agreement establishes an Unlimited Group Training Membership between Client and Bolt Fitness LLC. With its paid membership, Client will be permitted to use the basic facilities and equipment provided by Bolt Fitness, at 4545 N. Ravenswood Ave., Chicago, IL 60640, on an “open gym” basis. Client’s membership also will permit Client to register to attend any of our group classes, and will have online access to our group programming. Client’s membership does not include personal one-on-one training or semi-private training, or personal programming designed for Client’s specific goals, classes, each of which Client may schedule separately for additional fees.

Membership Term Options. Bolt Fitness offers its clients many different membership term options on its website, including single month, month-to-month, 4-, 6- and 8-month commitments, and a 12- month option. Client has selected from the above membership options in an online cart, and the option selected will create a “term” of the duration of Client’s membership. At the end of the selected duration, Client’s membership will automatically renew for the same term as originally selected, unless Client takes steps online to change its membership term, including to terminate its membership if Client chooses, at least 30 days in advance of the renewal date. The only membership option that will not automatically renew is the “single month” option, which is different from the month-to-month option which does renew monthly.

Membership Fees. The membership fees will differ depending on the membership term option selected by Client. In every case, however, membership fees must be paid in advance of the term selected. Thus, for example, if Client selects a month-to-month option, its fees must be paid in advance of the month of membership, on a recurring basis. If Client selects a 6-month commitment, its entire 6-month membership fee must be prepaid in advance of the 6-month term, and again in advance of the renewal term.

Payment. Clients will be charged automatically via a Client-authorized credit card provided by Client online. Payment by any other means is not permitted. By signing below, Client represents, warrants and agrees that: (a) Bolt Fitness is authorized to automatically charge Client’s credit card in the amount corresponding to the membership term option selected by Client, including for any renewal terms; (b) Client is the holder of the credit card provided, and is authorized to make payments from such account; and (c) there will be sufficient credit available when charged. Client will be notified if its credit card payment fails for any reason, and authorizes Bolt Fitness to charge Client and agrees that Client will pay all fees and charges incurred by Bolt Fitness as a result of such failure. Client also agrees to be charged and to pay a $10 fee if Client does not provide a valid credit card payment within 3 calendar days of the rejection date, and again for every 3 calendar days thereafter until a valid credit card payment has been made. Client understands that its membership and access to the services at Bolt Fitness will be deactivated if its account becomes more than 30 calendar days late, and in that event agrees to pay Bolt Fitness a liquidated damages fee in the amount of $410 (two months’ membership fees). Client agrees that this amount is a reasonable estimate of the damages to Bolt Fitness for Client’s non-payment under such circumstances.

Late Fees / No Shows. Client will be charged a $10 fee if it cancels less than 5 hours before a group class or program for which Client registered. Client will be charged a $15 fee if it fails to attend a group class or program for which Client registered.

Membership Freeze Policy. In the event of injury or extended vacations, once per year, Client may notify Bolt Fitness and at no additional charge Bolt Fitness will put a hold on Client’s membership for a period of 30 to 90 days, in one-month increments. To request a membership hold, Client must fill out and submit in person the Membership Freeze form available at our front desk. Following the end of the requested hold period, Client’s membership automatically will be reactivated (and, if applicable, the payment of its monthly fees will continue). Note, Client may only put its membership on hold once per 12-month period.

1-Month Freeze Extension (after a full 3-month freeze)

Client will be charged a fee of 50% of their monthly bill. Example: $185 x 0.50 = $92.50 to freeze their account for an extra month.

3-Month Freeze Extension (after a full 3-month freeze)

Client will be charged a fee equivalent to their monthly bill.

Cancellation Policies. CLIENT’S CONTINUED MEMBERSHIP IS AT THE SOLE DISCRETION OF BOLT FITNESS LLC, AND ANY VIOLATION OF THE RULES AND REGULATIONS, OR ENDANGERMENT OF CLIENT OR ANY OTHER PERSON, CAN RESULT IN CANCELLATION OF ACCESS AND MEMBERSHIP. Client may cancel its membership at any time with 30 days’ prior written notice. In order to cancel Client’s membership, Client must fill out and submit the Cancellation Form that will be provided by Bolt Fitness. For any cancellation by Client, there will be no refunds for any prepaid membership fees. If a client chooses to cancel before a membership commitment is reached, client will owe the $225 Early Termination Fee.

Personal Training Cancellation Policy:

If a client needs to cancel or reschedule a session, they must do so within 24 hours. Failure to cancel within this time frame will result in the trainer deducting a session from the pack/membership. If a client fails to show up to their scheduled session, trainer reserves the right to deduct the session.

Exceptions will only be made in the case of emergencies.

There is a no-refund policy on all purchases.

Bolt Fitness retains the right, in its sole discretion, to make exceptions to the no refund policy. For any cancellation by Client, there will be no refunds for any prepaid membership fees. Bolt Fitness retains the right, in its sole discretion, to make exceptions to the no refund policy.

Waiver and Release of Liability. As a condition to participate in any activities at Bolt Fitness, Client also must sign and submit in person the Waiver and Release of Liability form provided by Bolt Fitness.
